Official Rules for the New Year, New Look Sweepstakes!

“Weekly Sweepstakes”

PLEASE REVIEW THESE OFFICIAL RULES BEFORE ENTERING THE SWEEPSTAKES. NO PAYMENT OR PURCHASE IS NECESSARY TO ENTER OR WIN. A PAYMENT OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

  1. GENERAL CONDITIONS: The “Weekly Sweepstakes” (the “Sweepstakes”) is sponsored by Tea Collection, 1 Arkansas Street, Studio B, San Francisco, CA 94107, (the “Sponsor”) and administered by Tea Collection (the “Administrator”). By entering the Sweepstakes, each entrant agrees to abide by the terms of these Official Rules (the “Rules”) and by the decisions of the Administrator and Sponsor, which shall be made in their sole and absolute discretion and are final and binding on all matters relating to the Sweepstakes. The Sweepstakes is governed by the laws of the State of California and applicable U.S. federal law, without regard to any conflicts of laws principles. The Sweepstakes is void where prohibited by law. The Sweepstakes is also governed by the privacy policies of Tea Collection (http://www.teacollection.com/static/privacy-policy.html) (the “Privacy Policy”), although the Rules will govern in the event of any conflict between the Privacy Policies and the Rules.
  2. ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States (excluding Puerto Rico and including the District of Columbia) who are at least eighteen (18) years of age as of January 1, 2013. Entrants must have pre-existing Internet access and an email account in order to enter the Sweepstakes, and must be opted-in to receive email messages from Sponsor at the time of the random prize drawing in order to win. Employees, officers, and directors of Sponsor and their respective parents, subsidiaries, affiliates, dealerships (including retail stores), suppliers, and advertising, promotion and fulfillment agencies are not eligible to enter or win, nor are immediate family members or household members. “Immediate family members” means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, and spouses. “Household members” means those people who share the same residence at least three months a year.
  3. HOW TO ENTER: No payment or purchase is necessary, and a payment or purchase will not increase your chances of winning. The Sweepstakes begins at 12:01 am PST (“PT”) on January 22, 2013 and ends at 11:59 pm PT on January 24, 2013 (the “Sweepstakes Period”). To enter, go to Tea Collection’s Facebook page at [www.facebook.com/teacollection] (the “Sweepstakes Site”) and follow the instructions provided to enter. All entries must be received by 11:59 p.m. PT on January 25, 2013 (the “Deadline”). Proof of submission is not proof of receipt, and the Sponsor designated computer is the only valid official time-keeping devices for the Sweepstakes.

    Limit one (1) entry per person and one (1) entry per email address. Multiple entries received from any person or email address after the first entry received from that person or email address will be void. Entries without all of the required information will be disqualified. In addition, Sponsor will have no responsibility for, and will have the right to refuse in its sole and complete discretion, any mass entries or reproductions, any entries that have been tampered with or that reflect an attempt to tamper with the Sponsor website or Facebook page, the Sweepstakes Site, or the entry process, and any entries that are late, lost, stolen, illegible, misdirected, damaged, inaccurate, or incomplete, whether due to Internet or email server failure or otherwise. Sponsor and its agents are not responsible for lost, late, or misdirected entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the entries. Sponsor reserves the right to modify the scheduling of the Sweepstakes without prior notification. Any attempt at entry except as above stated is void. All entries become the property of the Sponsor and will not be acknowledged or returned. The Sponsor has the right to disqualify any entry that is not in compliance with these Rules, including all eligibility requirements.

    The Sponsor will be collecting personal data about participants when they register and enter the Sweepstakes. By participating in the Sweepstakes, you agree to all of the terms and conditions of the Privacy Policies. It is the entrant’s responsibility to inform the Administrator if the entrant’s contact information changes after the entry is submitted. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the entry is submitted.

  4. WINNER SELECTION AND NOTIFICATION: One (1) potential winner (“Potential Winner”) will be selected in a random drawing by the Sponsor or its designee on or about January 25, 2013.  The Potential Winner will be notified by email using the email address provided in the Sweepstakes entry (“Prize Notification”) and must respond by email within seven (7) calendar days of the date of the Prize Notification (the “Prize Deadline”), with Potential Winner’s full name and a mailing address (“Mailing Information”) where Sponsor can send his/her Prize (if warranted), and (if requested by Sponsor) a Declaration or Affidavit of Eligibility and Liability/Publicity Release in a form acceptable to the Sponsor (collectively, the “Sweepstakes Documents”). The mailing address must be a street address (no P.O. Boxes). If the Potential Winner does not respond to the Prize Notification by the Prize Deadline, he or she will be disqualified and an alternate Potential Winner will be selected from all remaining eligible entries received for the original drawing. The Sponsor is not responsible for the failure for any reason whatsoever any Potential Winner to receive his or her Prize Notification or for Sponsor to receive the Potential Winner’s responses and/or Sweepstakes Documents. Return of any Prize Notification or Sweepstakes Documents as undeliverable, the inability of Sponsor to contact the Potential Winner, the failure of the Potential Winner to contact the Sponsor in a timely manner, the inability of the Potential Winner to accept or receive the Prize for any reason, and/or the non-acceptance by the Potential Winner of any Prize for any reason will result in disqualification of such Potential Winner, and an alternate Potential Winner will be selected randomly from all remaining eligible entries received. A Potential Winner who receives a Prize is known as the “Winner”.

PRIZE: One (1) winner will receive a Tea Collection wardrobe set from the new South Africa collection found at www.teacollection.com under “new arrivals.” (Total ARV of $150) Limited to supplies on hand. Odds of winning depend on the number of eligible entries received before the Deadline. Prize details are in Sponsor’s sole discretion.:

 

  1. PRIZE CONDITIONS: All Prize values are stated in United States dollars. Selection and specifics of all Prizes will be determined at the Sponsor’s sole discretion. If a stated Prize is unavailable, Sponsor has the right to substitute one or more items of equal or greater value, in its sole and absolute discretion. Winner is not entitled to any surplus between the actual retail value of the Prize and its stated ARV. No cash redemption or prize substitution or exchange allowed. All Prizes are non-transferable. Winner will be solely responsible for complying with any and all applicable federal, state, provincial, local or other statutes, regulations, and other laws and for bearing any VAT, withholding taxes, personal income taxes, customs duties or other taxes, fees, insurance, surcharges or other costs relating to the Prize.

    ALL PRIZES, AND ALL PRODUCTS, SERVICES, OR ITEMS PURCHASED WITH ANY PRIZE, ARE PROVIDED AND AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. SPONSOR DOES NOT MAKE, AND EXPRESSLY DISCLAIM, ANY WARRANTY, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZE OR ANY PORTION THEREOF, OR ANY PRODUCT, SERVICE OR ITEM PURCHASED WITH ANY PRIZE, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. Acceptance, participation in and/or use of the Prizes, and any products, services or items purchased with the Prizes, are at the Winner’s sole risk and Sponsor is not responsible for any damages whatsoever, including special, indirect, or consequential damages, arising out of or in connection with the use and/or misuse of any of the Prize or any products, services or items purchased with the Prize. Prizes will be awarded by email, U.S. Mail, Federal Express, UPS and/or other shipping method, in Sponsor’s and/or its Prize suppliers’ sole discretion, using the information provided in the Sweepstakes Entry.

  2. REPRESENTATIONS: By entering the Sweepstakes, each entrant represents and warrants that: (a) the entrant meets all eligibility requirements of the Sweepstakes; (b) in entering and participating in the Sweepstakes, the entrant has complied with and will comply in all respects with these Rules and all applicable statutes, regulations and other laws; and (c) the information provided in the entrant’s entry, including without limitation all contact information, is true, accurate and complete in all respects.
  3. GRANT OF RIGHTS: By accepting a prize, each Winner consents to the use of his/her name and/or likeness (voice, biographical information, city and state of residence, statements, photograph, and recording) for advertising and promotional purposes (including, but not limited to, use on Sponsor’s web site and/or Facebook pages) without additional compensation, except where prohibited by law.
  4. RELEASE: All decisions of Sponsor are final and binding, and entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Rules, except where prohibited by law. To the maximum extent permitted by law, by entering the Sweepstakes, each entrant releases and holds harmless the Sponsor, Administrator, the Prize manufacturers or suppliers, any other entities involved in the administration of the Sweepstakes, each of their respective parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents and representatives (the “Sponsor Parties“) from any and all responsibility, liability, damages (including without limitation direct, indirect, incidental, consequential, punitive, statutory and other damages), losses, costs, or expenses of any kind arising out of or relating to: (a) the Sweepstakes and participation in the Sweepstakes by the entrant; (b) any violation by the entrant of these Rules or applicable laws; (c) the acceptance, possession, receipt, or use of any Prize or any product, service, or item purchased with any Prize; (d) any entries that have been tampered with, or that evidence an attempt to tamper with the Sponsor website or Facebook page,  the Sweepstakes Site, or the entry process, or that are misdirected, incomplete, non-conforming, corrupt, lost, late, or ineligible; (e) any problems or technical malfunctions (including but not limited to errors, omissions, interruptions, deletions, defects, or delays in operation or transmission) of any computer, telephone, modem, cable, satellite, network, hardware, online system, server, software, or other equipment or provider, including any incorrect, incomplete, garbled or jumbled information resulting there from; (f) any Internet traffic congestion or website accessibility or delays; (g) printing or typographical errors in any Sweepstakes-related materials; or (h) any other technical or human error that may occur in connection with the Sweepstakes (the “Causes“). If anyone makes any claim against any of the Sponsor Parties arising out of or relating to any of the Causes attributable to the entrant, the entrant will pay for any damages, losses, liabilities, costs, penalties, and expenses, including without limitation attorneys’ and experts’ fees and costs, incurred in connection with such claim. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE SPONSOR PARTIES SHALL NOT BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE SWEEPSTAKES, HOWSOEVER CAUSED, WHETHER ARISING IN STATUTE, TORT, CONTRACT, OR OTHER LEGAL THEORY, AND ALL SUCH DAMAGES ARE HEREBY DISCLAIMED AND EXCLUDED.

10.  USE OF PERSONAL INFORMATION: In order to participate in this Sweepstakes, participants will be required to supply certain information about themselves. Sponsor has specified which information is mandatory in order to participate in the Sweepstakes. By entering the Sweepstakes, each participant agrees that such information can be used by Sponsor in connection with administering the Sweepstakes and as set forth in the Privacy Policies.

11.  CHANGES AND TERMINATION: Sponsor reserves the right to make changes or additions to these Rules and/or extend the dates of this Sweepstakes for any reason at any time. Sponsor failure to enforce any term of these Rules shall not constitute a waiver of that provision. Sponsor reserves the right to suspend, modify or terminate the Sweepstakes at any time and for any reason in its sole discretion, including without limitation in the event of fraud, abuse, tampering, or technical, administrative, financial or other difficulties. In such cases, Sponsor will post notice on the Sweepstakes Site. Should the Sweepstakes terminate prior to selection of a winner, an alternate means of awarding the prizes will be announced on the Sweepstakes Site.

12.  CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

13.  DISPUTES: Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in San Francisco, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys fees and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased.

14.  MISCELLANEOUS: If any part of these Rules is held by a court of competent jurisdiction to be invalid, illegal, or otherwise unenforceable, such part will be modified by such court to the minimum extent necessary to make it enforceable while preserving to the maximum extent possible the original intent of Sponsor, and the remaining parts of these Rules will remain in full force and effect. Nothing contained herein or in any of the Sweepstakes-related materials should be construed as an endorsement by Sponsor of any third party, product or service.

15.  WINNER’S LIST/OFFICIAL RULES: For a list of Winners or a copy of the Rules, please send a self-addressed stamped envelope to: “Weekly Sweepstakes,” Winner’s List/Official Rules, c/o Tea Collection, One Arkansas Street, Suite B, San Francisco, CA 94107, to be received no later than January 31, 2013. Winners’ lists will be sent once all Winners have been verified and Prizes have been awarded.

Official Rules for Activity Book Contest

1. General Conditions. The “Activity Book” Contest (the “Contest”) is a skill-based contest sponsored by Tea Living Inc. Tea Collection, 1 Arkansas St., Studio B, San Francisco, CA 94107 (the “Sponsor” or “Tea”). By entering the Contest, each entrant agrees to abide by the terms of these Official Rules (the “Rules”) and by the decisions of the Sponsor and Judge (as defined below), which shall be made in their sole and absolute discretion and are final and binding on all matters relating to the Contest. The Contest is governed by the laws of the State of California and applicable U.S. federal law, without regard to any conflicts of laws principles. The Contest is void where prohibited by law. The Contest is also governed by the Privacy Policy pertaining to the www.teacollection.com website (the “Sponsor Site”), although the Rules will govern in the event of any conflict between the Privacy Policy and the Rules. 2. Who Can Enter. The Contest is open only to natural persons who, as of the date of entry, are legal residents of the 50 United States (including the District of Columbia), are at least eighteen (18) years old, have Internet access and a Facebook account, and have not won the Contest in the preceding 12 months. Employees, officers and directors of Sponsor, its parents, subsidiaries, affiliates, and their partners (including store owners), suppliers, or advertising, promotion, and fulfillment agencies are not eligible to enter or win, nor are their immediate family members or members of their household. “Immediate family members” means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household members” means those people who share the same residence at least three months a year. 3. How To Enter: Submit a photo of your child’s artwork by email to blog@teacollection.com 4. Conditions of Entry: An entry consists of one (1) submitted photo (the “Submission”). The entrant must either be the parent or guardian of the child depicted in the Submission or have obtained permission from the child’s parent or guardian to submit the Submission. By entering the Contest, you authorize Sponsor to use and publish the Submission in connection with the administration and promotion of the Contest. Submissions must be original and must not contain any material that is degrading, defamatory, fraudulent, obscene, indecent or otherwise objectionable, or that infringes the legal rights of any third party. The entry must be received by the Deadline for that entry to be valid. Proof of submission is not proof of the Sponsor’s receipt and the Sponsor’s designated computer is the only valid official time-keeping device for the Contest. Entries without all of the required information will be disqualified. In addition, the Sponsor will have no responsibility for, and will have the right to refuse and/or disqualify, in its sole and complete discretion, any entries that do not comply with these Official Rules, any entries that have been tampered with, and any entries that are late, lost, illegible, inaccurate, misdirected, non-conforming, corrupt, or otherwise incomplete, whether due to Internet or email server failure, failure of the store staff to transmit them, or otherwise. Upon submission, all entries become the sole property of the Sponsor and will not be acknowledged or returned. Any attempt at or form of entry other than as expressly specified in these rules (including but not limited to automated, copied, third-party or mechanically reproduced entries) is strictly prohibited and will result in disqualification. Sponsor will be collecting personal data about participants when they register and enter the Contest, and may share that personal data with prize suppliers, fulfillment providers, and other entities involved in the administration of the Contest. By participating in the Contest, you agree to all of the terms and conditions of the Privacy Policy. It is the entrant’s responsibility to inform the Sponsor if the entrant’s contact information changes after the entry is submitted. 5. Selection of Winners: One (1) winner will be selected each month. The Judge will give each Submission up to 10 points for each of the following three criteria, for a maximum possible total of 30 points: (a) creativity; (b) composition; and (c) how well the Submission embodies the spirit of tea. The Submission with the highest total score will be that month’s winner. 7. Prize Terms: All prize values are stated in United States dollars. If a stated prize is unavailable, Sponsor has the right to substitute one or more items of equal or greater value, in its sole and absolute discretion. No prize is exchangeable, transferrable, or redeemable for cash. The winner will be solely responsible for complying with any and all applicable federal, state, provincial, local or other statutes, regulations, and other laws and for bearing any personal income, VAT, withholding taxes, customs duties, or other taxes, fees, insurance, surcharges or other costs relating to any prize. Gift cards may be subject to dormancy fees, state unclaimed property laws, and may not be valid for all goods or services or in all locations. Items purchased with gift cards will be subject to Sponsor’s return and other policies. THE PRIZE(S), AND ANY ITEMS PURCHASED WITH THE PRIZES, ARE PROVIDED “AS IS.” SPONSOR DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY, REGARDING ANY PRIZE OR ANY PORTION THEREOF, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. 8. Winner Notification: The monthly winners will be selected on or about the seventh (7th) day after the Deadline. Winners will be notified by email within fourteen (14) days of selection and are required to sign and return, if requested by Sponsor, an affidavit of eligibility and/or publicity and/or liability release form, to the extent not prohibited by law, prior to receipt of a prize. Winners must take possession of prizes as directed by Sponsor. Winners may be required to provide Sponsor with their social security or taxpayer identification number for tax purposes. Winners may also be required to provide Sponsor with proof that they are the Authorized Account Holder of the email address associated with the winning entry. An “Authorized Account Holder” is the natural person who is assigned to an email address by an Internet access provider or other organization responsible for assigning email addresses to the domain associated with the email address. In the event of a dispute, an entry will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. Failure to respond to the winner announcement or return any required declarations or releases within seven (7) days (or any longer time specified by Sponsor in its sole discretion) or to comply with any of the foregoing, may result in disqualification and the selection of an alternate winner. 9. Representations: By entering the Contest, each entrant represents and warrants that: (a) the entrant meets all eligibility requirements of the Contest; (b) in entering and participating in the Contest, the entrant has complied with and will comply in all respects with these Rules and all applicable statutes, regulations and other laws; and (c) the information provided in the entrant’s entry, including without limitation all contact information and all information about the identity of the person who took the Photo that is part of the Submission, is true, accurate and complete in all respects. Each entrant further represents and warrants that (x) the entrant took the photo and owns all rights in and to it, (y) the photo is an original work of authorship, has not been copied, in whole or in part, from any other work, and does not violate any legal right of any third party, and (z) the entrant is the parent or legal guardian of the child depicted in the photo, or has received permission from the child’s parent or legal guardian to submit the photo. 10. Release: To the maximum extent permitted by law, by entering the Contest, each entrant releases and holds harmless the Sponsor, the prize manufacturers or suppliers, any other individuals or entities involved in the administration of the Contest, each of their respective parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents and representatives (the “Sponsor Parties”) from any and all responsibility, liability, damages (including without limitation direct, indirect, incidental, consequential, punitive, statutory and other damages), losses, costs, or expenses of any kind arising out of or relating to: (a) the Contest and participation in the Contest by the entrant and the child depicted in the photo; (b) any violation by the entrant of these Rules or applicable laws; (c) the acceptance, possession, receipt, or use of any prize or any item purchased with any prize; (d) any entries that have been tampered with or that are misdirected, incomplete, non-conforming, corrupt, lost, late, or ineligible; (e) any problems or technical malfunctions (including but not limited to errors, omissions, interruptions, deletions, defects, or delays in operation or transmission) of any computer, telephone, modem, cable, satellite, network, hardware, online system, server, software, or other equipment or provider, including any incorrect, incomplete, garbled or jumbled information resulting therefrom; (f) any Internet traffic congestion or website accessibility or delays; (g) printing or typographical errors in any Contest-related materials; or (h) any other technical or human error that may occur in connection with the Contest (the “Causes”). Termination: The Sponsor reserves the right to suspend, modify or terminate the Contest at any time and for any reason in its sole discretion, including without limitation in the event of fraud, abuse, tampering, or technical, administrative, financial or other difficulties. In such cases, Sponsor will post notice on the Contest page of the Sponsor Site. Should the Contest terminate prior to selection of a winner, Sponsor will announce an alternate means of awarding the prize on the Contest page of the Sponsor Site. 12. Grant of Rights to Sponsor. All Submissions (including photos) and related entry materials become the property of Sponsor and will not be returned to the entrant. To the maximum extent permitted by law, by entering the Contest, each entrant irrevocably and perpetually consents, on behalf of the entrant and the child depicted in the entry, to use by the Sponsor (or any third party chosen by the Sponsor) of the photo and of any and all information, photos, drawings, text or other material contained in an entry or otherwise provided by such entrant related to the Contest (including any personal information obtained through the Contest), in connection with the administration and promotion of the Contest and for other purposes not prohibited by law. Ways to Introduce your Kids to French Culture

We’re excited to have Julia Pimsleur Levine, founder of Little Pim as our guest blogger today. Little Pim is the ultimate language learning gift for babies, toddlers and preschoolers – to learn more, visit What is Little Pim.

As the creator of the Little Pim foreign language teaching series for kids, people often ask me if my own sons, 3 and 7, speak French. They do speak passable French, but what is more important to me than the number of words they know is that they have fallen in love, as I did, with the French culture, sights, smells and tastes. Learning conjugations can come later.

Below are some of the ways we introduced our boys to French culture, language, and of course, le chocolat, on a recent trip to Antibes, France. Take a little voyage right here avec nous! (with us)

When kids want ice cream is a great time to get them to use their foreign language words… Even the most reluctant young student of French, Spanish or Italian suddenly finds courage in the face of ice cream. “Une glace au chocolat, s’il vous plaît” rolled right off my children’s tongue when we got to France! By the end of our two weeks there, they could say all the flavors and colors, a yummy and lasting learning experience!


We also got to attend a traditional French marionette show, where we saw carefully crafted paper maché puppets made in the same way they have been made for the last 100+ years in France …. And probably told the same jokes they have told for the last 100 years too. My three year old laughed himself silly and my seven year old scowled and could only be persuaded to sit through it on the promise of mousse au chocolat after dinner.  C’est la vie!

No trip to France would be complete without a ride on one of their ornate and spectacular Carrousels. These are nothing like the US mall version and are a great place to teach kids words like avion (plane), cheval (horse) and unicorne (an easy one!).

Ever since the trip, both boys greet me in the morning with a half-joking “Bonjour maman!” in unison, and thank me for their Cheerios with “Merci maman!”. And they don’t even realize that with all the amazing things they experienced this trip, the best is yet to come!

Fall Tea Stylista Winner!

And the winner of the Fall Tea Stylista contest is….. Tatum from Eugene, Oregon!

We were so impressed by her distinct sense of style and use of accessories to personalize all her Tea outfits! Tatum describes her style as “fun, colorful, and unique” and she absolutely loves to accessorize her looks with scarves, boots, and jewelry. Her fashion influences are her mom, friends, and occasionally someone or something on TV or in a catalog will inspire her as well.

Tatum will be coming to San Francisco in December for a tour of the Tea studio and a personal photo shoot where she can showcase all her favorite Tea outfits! We’re so excited to meet her and can’t wait to congraulate her in person!

Announcing the Fall Stylista Finalists!

With much excitement, we’re proud to announce the finalists for the Fall 2011 Stylista competition!

We were on a search for fashion-forward 8-12 year olds to show us their unique style and we couldn’t be happier with the submissions we received! Fashionistas from all across the United States submitted their photos online or by visiting their local Tea retailer. Specifically, these stylish boys and girls created fantastic outfits that featured at least two pieces of Tea clothing.

The winner will receive an all expenses paid trip to San Francisco for a behind the scenes tour of the Tea headquarters.  Also, the winner will have her own photo shoot where she is able to show off all her fashionable outfits in front of the camera!

It was incredibly challenging to choose since we received quite a few outstanding candidates, but a small group on Tea’s Creative team evaluated all submissions based on the child’s creativity, visual flair, and how much his or her outfit embodied the Tea spirit. After much deliberation, the selection committee chose three finalists and one honorable mention:

Tatum

From Eugene, OR, 8 year old Tatum enjoys Tea because of the “fabulous colors, unique style, and the clothing is more than anything, fun to wear!”

Juliana

From Orland, CA, 10 year old Juliana provided us quite a few reasons on why she loves Tea. She told us “I love Tea because I like to draw, paint, and create sculptures and the clothes show my creative side.  I can come up with lots of different outfits with just a few dresses and shirts from Tea.”

Halle

9 year old, Halle from Reno, NV adores Tea for the “amazing styles and fabrics!”

Fiona [Honorable Mention]

Fiona, from Bozeman MT, is 10 years old and submitted such a compelling story for why she loves Tea.  She stated “. I love to wear your clothes because they express my individual style, which is countryside chic. I also love to wear your clothes because I love to travel, and your clothes remind me of our recent family trips to eastern Europe and Mexico. As well as traveling, I also enjoy drawing. Your catalogs and your clothes inspire my imagination to create beautiful clothes for the little girls in my pictures. Thank you, Tea, for designing the most wonderful clothes and outfits!”

Official Rules: Inspiring Mom Awards

Official Rules
“Inspiring Moms” Contest

PLEASE REVIEW THESE OFFICIAL RULES BEFORE ENTERING THE CONTEST.  VOID WHERE PROHIBITED BY LAW.

NO PAYMENT OR PURCHASE IS NECESSARY TO WIN.  PAYMENT OR PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

  1. General Conditions. The Tea “Inspiring Moms” Contest (the “Contest”) is a skill-based contest sponsored by Tea Living Inc. dba Tea and Tea Collection (the “Sponsor” or “Tea”). By entering the Contest, each entrant agrees to abide by the terms of these Official Rules (the “Rules”) and by the decisions of the Sponsor and Judges (as defined below), which shall be made in their sole and absolute discretion and are final and binding on all matters relating to the Contest. The Contest is governed by the laws of the State of California and applicable U.S. federal law, without regard to any conflicts of laws principles. The Contest is void where prohibited by law. The Contest is also governed by the Privacy Policy pertaining to the www.teacollection.com website (the “Sponsor Site”), although the Rules will govern in the event of any conflict between the Privacy Policy and the Rules.
  2. Who Can Enter. The Contest is open only to natural persons who, as of the date of entry, are legal residents of the 50 United States (including the District of Columbia), are at least eighteen (18) years old, and have Internet access and a Facebook account. Employees, officers and directors of Sponsor, its parents, subsidiaries, affiliates, and their partners (including store owners), suppliers, or advertising, promotion, and fulfillment agencies are not eligible to enter or win, nor are their immediate family members or members of their household. “Immediate family members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household members” shall mean those people who share the same residence at least three months a year.
  3. How To Nominate an Inspiring Mom: Nominations for the Contest (each, a “Nomination”) will be accepted starting at [time] Pacific Time (PT) on October 12, 2012 and ending at 11:59 p.m. PT on October 23, 2012 (the “Nomination Period”). A person who submits a Nomination is referred to in these Official Rules as a “Nominator.” To nominate an Inspiring Mom, visit www.facebook.com/teacollection and follow the links and instructions to nominate the person you wish to submit for the Contest (the “Nominee”). You can nominate a Nominee in one of three categories:
  • Globetrotter: A mom who instills the values of raising little citizens of the world – whether it be through traveling or living abroad or teaching her kids about global cultures through training and discovery.
  • Making a Difference: A mom who is involved in her community and is working to solve problems locally or globally, whether by working with a community organization or running a nonprofit.
  • Mompreneur: A mom who pursues her business or profession with passion and excels at work/home balance.

When you submit a Nomination, you must provide the Nominee’s name and email address, your own name and email address, and a description of the Nominee’s accomplishments (a “Narrative”); if the Nominee has a Twitter handle, you can provide that at your option. Together, the Narrative and contact information you submit is called the “Submission.” You may nominate more than one Nominee, but you may not nominate an individual Nominee more than once. If you nominate the same individual Nominee more than once, only the first Nomination will count. The submission of a Nomination is solely the responsibility of the Nominator, and Nominations can be made only using the method described above.

  1. Selection of Semifinalists: All Submissions in each category will be judged by two (2) of Sponsor’s staff (each, a “Judge”). For each category, the Judges will select five (5) semifinalists from among all eligible Submissions received in that category by the end of the Nominating Period. Each Judge will score the eligible Submissions on three general criteria and two category-specific criteria, all weighted equally. The judging criteria are:

General criteria:

  • How much does she inspire you?
  • How often does she “go there” – either across the street or across the globe to raise her kids as little citizens of the world?
  • Does she have good work/life balance?

Category-specific criteria:

Globetrotter:

  • Has she found new and innovative ways to introduce her children to different cultures?
  • Does she try to bring her children with her when she travels internationally?

Making a Difference:

  • Is she making a difference in her community?
  • Is she a setting a good example for her children of why volunteering and helping your community is important?

Mompreneur:

  • Is her company making a difference for its customers?
  • Is she setting a good example of entrepreneurial independence for her children?

 

Each Judge will award up to 10 points per criterion, for a maximum possible total of 50 points, and the scores of the Judges will be added to determine a Submission’s total score. If there is a tie, the tied entries will be rescored as described above by Sponsor’s CEO and Chief Creative Officer.

  1. Selection of Finalists: Nominees who are selected as semifinalists will receive an email from Sponsor on or about October 26, 2012 notifying them that they have been selected. The Nominee can either accept or reject the Nomination by replying to the email and taking the following steps:
  • To reject a Nomination, reply to the email with the word “REJECT” in the subject line.
  • To accept a Nomination: (1) No later than 5 pm PT on October 29, 2012, reply to the email with the word “ACCEPT” in the subject line; and (2) no later than 5 pm PT on October 30, 2012, send Sponsor a picture that can be used in connection with judging and published on Sponsor’s Facebook page and website. Nominees can, at their option, also provide Sponsor with their Facebook, Twitter and other social media handles, but failure to provide handles will not disqualify a Nominee.

Semifinalists who accept their Nominations as described above will be judged by two (2) Judges selected by Sponsor as embodying the qualities of the applicable category. Each Judge will review the semifinal entries in her category and score them on the general and category-specific criteria described in Section 4, awarding up to 10 points per criterion for a maximum possible score of 50 points. The two Judges’ scores will be added to determine a semifinalist’s total score. The semifinalists with the top three (3) scores in each category will become finalists. In the event of a tie, the applicable Submissions will be rescored as described above by Sponsor’s CEO and Chief Creative Officer.

  1. Selection of Winners: Finalists will be announced and their Submissions posted on Sponsor’s Facebook page on or about November 1, 2012. Starting when the finalists are posted and ending at 11:59 pm PT on November 15, 2012 (the “Public Voting Phase”), members of the public (“Voters”) may visit Sponsor’s Facebook page, view the finalists’ Submissions, and vote for the finalist in each category that the Voter believes best embody the values of the Tea brand and the judging criteria for that category. The Nominee who receives the highest number of votes in each category during the Public Voting Period will be named as the potential Grand Prize Winner for that category, subject to verification. In the event of a tie, Sponsor’s CEO and Chief Creative Officer will choose the potential Grand Prize Winner by scoring the tied entries as described in Section 4 above.
  2. 7. Prizes:  Three (3) Grand Prizes: The Grand Prize Winner in each category will win the opportunity to have Sponsor make a $1,000 donation to the children’s charitable organization of her choice. Donations will be made directly by Sponsor to qualifying charitable organizations, and no funds will be provided to the Grand Prize Winners. In order to qualify, the charitable organization must be a valid 501(c)(3) organization whose primary mission involves working for the benefit of children. Decisions about whether a charity qualifies for a donation will be made by Sponsor in its sole discretion. One (1) Nominator Prize: Each Nominator who submits a valid Nomination during the Nomination Period will receive a chance to win a $250 Tea Collection gift certificate, good at www.teacollection.com. The winner of the Nominator Prize will be chosen at random from all valid Nominations received; odds of winning depend on the number of valid Nominations received during the Nomination Period.
  3. Prize Terms: All prize values are stated in United States dollars. If a stated prize is unavailable, Sponsor has the right to substitute one or more items of equal or greater value, in its sole and absolute discretion. No prize is exchangeable, transferrable, or redeemable for cash. The winner will be solely responsible for complying with any and all applicable federal, state, provincial, local or other statutes, regulations, and other laws and for bearing any personal income, VAT, withholding taxes, customs duties, or other taxes, fees, insurance, surcharges or other costs relating to any prize. THE PRIZE(S) WILL BE GIVEN AWAY BY THE SPONSOR “AS IS.” SPONSOR DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY, REGARDING ANY PRIZE OR ANY PORTION THEREOF, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
  4. Award of Prize: The Grand Prize winners and Nominator Prize Winner will be selected on or about November 16, 2012. The potential winners will be notified by email within fourteen (14) days of selection. PLEASE NOTE: EVEN IF YOUR NOMINATION IS CHOSEN AS A POTENTIAL GRAND PRIZE WINNER AT THE CONCLUSION OF THE PUBLIC VOTING PERIOD, YOU HAVE NOT YET WON A PRIZE. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION OF ELIGIBILITY BY THE SPONSOR BEFORE ANY PRIZE IS AWARDED. The potential winners may required to sign and return, when requested, an affidavit of eligibility and/or publicity and/or liability release form, to the extent not prohibited by law, prior to receipt of a prize. The winner must take possession of the prize as directed by Sponsor. The winner may be required to provide Sponsor with his or her social security or taxpayer identification number for tax purposes. The winner may also be required to provide Sponsor with proof that he or she is the Authorized Account Holder of the email address associated with the winning entry. An “Authorized Account Holder” is the natural person who is assigned to an email address by an Internet access provider or other organization responsible for assigning email addresses to the domain associated with the email address. In the event of a dispute, an entry will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. Failure to respond to the winner announcement or return any required declarations or releases within seven (7) days (or any longer time specified by Sponsor in its sole discretion) or to comply with any of the foregoing, may result in disqualification and the selection of an alternate winner.
  5. Restrictions and Conditions of Entry: Submissions must be in English, original, must not have been previously published, and must not contain any material that is degrading, defamatory, fraudulent, obscene, indecent or otherwise objectionable, that infringes the legal rights of any third party, or that promotes, contains or references any product, service, company name, logo or trademark (other than those of the Sponsor). All Submissions will be reviewed prior to publication, but such review does not relieve the Nominator from responsibility for compliance with these Official Rules. Submissions that do not comply with these Official Rules, or that otherwise contain prohibited or in appropriate content (as determined by Sponsor in its sole discretion) will be disqualified and will not be published or considered for a prize. Submissions must be received by the end of the Nomination Period in order to be valid. Proof of submission is not proof of the Sponsor’s receipt and the Sponsor’s designated computer is the only valid official time-keeping device for the Contest. Submissions without all of the required information will be disqualified. In addition, the Sponsor will have no responsibility for, and will have the right to refuse in its sole and complete discretion, any entries that have been tampered with and any entries that are late, lost, illegible, inaccurate, misdirected, non-conforming, corrupt, or otherwise incomplete, whether due to Internet or email server failure, failure of the store staff to transmit them, or otherwise. Upon submission, all entries become the sole property of the Sponsor and will not be acknowledged or returned. Any attempt at or form of entry other than as expressly specified in these rules (including but not limited to automated, copied, third-party or mechanically reproduced entries) is strictly prohibited and will result in disqualification. Entrants are prohibited from artificially inflating or attempting to artificially inflate the number of votes received by any finalist, whether by offering prizes or other inducements to members of the public, vote farming, or any other such activity as determined by Sponsor in its sole discretion. Sponsor will be collecting personal data about participants when they register and enter the Contest. By participating in the Contest, you agree to all of the terms and conditions of the Privacy Policy. It is the entrant’s responsibility to inform the Sponsor if the entrant’s contact information changes after the entry is submitted.
  6. Representations: By entering the Contest, each entrant represents and warrants that: (a) the entrant meets all eligibility requirements of the Contest; (b) in entering and participating in the Contest, the entrant has complied with and will comply in all respects with these Rules and all applicable statutes, regulations and other laws; and (c) the information provided in the entrant’s entry, including without limitation all contact information and all information about the identity of the person who took the photo that is part of the Submission, is true, accurate and complete in all respects. Each Nominator further represents and warrants that (a) the Narrative submitted by the Nominator is true and correct, and (b) the Narrative is the Nominator’s original work and does not infringe the intellectual property or other legal rights of any third party. Each Nominee further represents and warrants, by accepting the Nomination, that (x) she has reviewed and approved the Submission and it is true and correct; (y) she agrees to these Official Rules; and (z) she has obtained all necessary permissions regarding the photo submitted in connection with her nomination, including but not limited to any permissions from the photographer and any other person pictured, and can grant rights in the photo to Sponsor as described in these Official Rules.

Release: To the maximum extent permitted by law, by entering the Contest, each Nominator and Nominee (each, an “entrant”) releases and holds harmless the Sponsor, the prize manufacturers or suppliers, any other entities involved in the administration of the Contest, each of their respective parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents and representatives (the “Sponsor Parties”) from any and all responsibility, liability, damages (including without limitation direct, indirect, incidental, consequential, punitive, statutory and other damages), losses, costs, or expenses of any kind arising out of or relating to: (a) the Contest and participation in the Contest by the entrant; (b) any violation by the entrant of these Rules or applicable laws; (c) the acceptance, possession, receipt, or use of any prize or any item purchased with any prize; (d) any entries that have been tampered with or that are misdirected, incomplete, non-conforming, corrupt, lost, late, or ineligible; (e) any problems or technical malfunctions (including but not limited to errors, omissions, interruptions, deletions, defects, or delays in operation or transmission) of any computer, telephone, modem, cable, satellite, network, hardware, online system, server, software, or other equipment or provider, including any incorrect, incomplete, garbled or jumbled information resulting therefrom; (f) any Internet traffic congestion or website accessibility or delays; (g) printing or typographical errors in any Contest-related materials; or (h) any other technical or human error that may occur in connection with the Contest (the “Causes”).  If anyone makes any claim against any of the Sponsor Parties arising out of or relating to any of the Causes attributable to the entrant, the entrant will pay for any damages, losses, liabilities, costs, penalties, and expenses, including without limitation attorneys’ and experts’ fees and costs, incurred in connection with such claim.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE SPONSOR PARTIES SHALL NOT BE LIABLE FOR ANY LOST PROFITS OR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE CONTEST, HOWSOEVER CAUSED, WHETHER ARISING IN STATUTE, TORT, CONTRACT, OR OTHER LEGAL THEORY, AND ALL SUCH DAMAGES ARE HEREBY DISCLAIMED AND EXCLUDED.
  8. Termination: The Sponsor reserves the right to suspend, modify or terminate the Contest at any time and for any reason in its sole discretion, including without limitation in the event of fraud, abuse, tampering, or technical, administrative, financial or other difficulties. In such cases, Sponsor will post notice on the Contest page of the Sponsor Site. Should the Contest terminate prior to selection of a winner, Sponsor will announce an alternate means of awarding the prize on the Contest page of the Sponsor Site.
  9. Use of Submissions; Grant of Rights to Sponsor. All Submissions (including photos provided by semifinalists) and related entry materials become the property of Sponsor and will not be returned to the entrant. To the maximum extent permitted by law, by entering the Contest, each entrant irrevocably and perpetually consents to use by the Sponsor (or any third party chosen by the Sponsor) of the Submission and of any and all information, photos, drawings, text or other material contained in the Submission  or otherwise provided by such entrant related to the Contest in connection with administering and publicizing the Contest or future Sponsor promotions. This consent includes the right for Sponsor, or any third party chosen by Sponsor, to publish, use, adapt, edit and/or modify entry photos in any way, to distribute them in any and all media worldwide, and to do so without compensation to the entrant, the photo subject, or any other person or entity. To the maximum extent permitted by law, by accepting a prize, the winner consents to the print and online publication of his or her name, address and winning Submission as part of a winners’ list and to use of his or her winning Submission, name, voice, photograph, biographical material, and likeness by Sponsor or any third party third party chosen by Sponsor, as set forth in this Section 14. Other than as set forth herein, Sponsor will treat any personal information supplied by entrants in connection with the Contest in accordance with the Privacy Policy.
  10. Miscellaneous: Any dispute between Sponsor and an entrant arising out of or relating to these Rules, the Contest, or any prize must be brought exclusively in the state or federal courts located in the City and County of San Francisco, California and must be brought individually, without resort to any form of class action. By entering the Contest, each entrant submits to the jurisdiction of those courts and waives any objection to those courts, whether on the basis of jurisdiction, venue, inconvenience of the forum, or otherwise. If any part of these Rules is held by a court of competent jurisdiction to be invalid, illegal, or otherwise unenforceable, such part will be modified by such court to the minimum extent necessary to make it enforceable while preserving to the maximum extent possible the original intent of Sponsor, and the remaining parts of these Rules will remain in full force and effect. Nothing contained herein or in any of the Contest related materials should be construed as an endorsement by Sponsor of any third party, product or service.

  1. GENERAL CONDITIONS: The “Welcome Baby” Sweepstakes (the “Sweepstakes”) is sponsored by Tea Collection, 1 Arkansas Street, Studio B, San Francisco, CA 94107,The Honest Company, 1550 17th Street, Santa Monica, CA 90404, and timi & leslie, c/o Essentials Brands, Inc. 154 East Central Street, Suite 202, Natick, MA 01760 (together, the “Sponsors”) and administered by Offerpop, 25 West 36th Street, 11th Floor, New York, NY 10018(“Administrator”). By entering the Sweepstakes, each entrant agrees to abide by the terms of these Official Rules (the “Rules”) and by the decisions of the Sponsors and Administrator, which shall be made in their sole and absolute discretion and are final and binding on all matters relating to the Sweepstakes. The Sweepstakes is governed by the laws of the State of California and applicable U.S. federal law, without regard to any conflicts of laws principles. The Sweepstakes is void where prohibited by law.   2. ELIGIBILITY: The Sweepstakes is open to natural persons who, as of September 27, 2012, are legal residents of the 50 United States and the District of Columbia, have a Facebook account, are at least 18 years of age, and have internet access. Employees, officers, and directors of Sponsors and their respective parents, subsidiaries, affiliates, dealerships (including retail stores), suppliers, and advertising, promotion and fulfillment agencies are not eligible to enter or win, nor are immediate family members or household members. “Immediate family members” means parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, and spouses. “Household members” means those people who share the same residence at least three months a year.
  3. HOW TO ENTER: No payment or purchase is necessary, and a payment or purchase will not increase your chances of winning. The Sweepstakes begins at 12:01 am PT on Thursday, September  27, 2012. To enter, go to http://www.facebook.com/teacollection (the “Application) and click on the Facebook tab that reads “Baby Sweeps.” Then choose the bundle of your choice. Once you choose a bundle, you will be directed to a sign up page where you will be asked to enter your first name, last name, and email address and agree to the Official Rules. Once you sign up, you will be directed to a “Thank you” page. All entries must be received by 11:59 p.m. PT on October 8, 2012 (the “Deadline”). Proof of submission is not proof of receipt, and the Administrator’s designated computer is the only valid official time-keeping devices for the Sweepstakes.

    For each bundle, there is a limit of one (1) entry per person and one (1) entry per email address. Multiple entries received from any person or email address after the first entry received from that person or email address will be void. Entries without all of the required information will be disqualified. In addition, Sponsors and Administrator will have no responsibility for, and will have the right to refuse in their sole and complete discretion, any mass entries or reproductions, any entries that have been tampered with, and any entries that are late, lost, stolen, illegible, misdirected, damaged, inaccurate, or incomplete, whether due to Internet or email server failure or otherwise. Sponsors, Administrator and their agents are not responsible for lost, late, or misdirected entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the entries. Sponsor reserves the right to modify the scheduling of the Sweepstakes without prior notification. Any attempt at entry except as above stated is void. All entries become the property of the Sponsors and will not be acknowledged or returned. The Administrator has the right to disqualify any entry that is not in compliance with these Rules, including all eligibility requirements.

    The Administrator will be collecting personal data about participants when they register and enter the Sweepstakes. By participating in the Sweepstakes, you agree to all of the terms and conditions of the Privacy Policy. It is the entrant’s responsibility to inform the Administrator if the entrant’s contact information changes after the entry is submitted. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered on the date the entry is submitted.

  4. WINNER SELECTION AND NOTIFICATION: Potential winners (“Potential Winners”) will be selected in a random drawing by the Administrator or its designee. Drawings will happen on or about October 9, 2012. Each Potential Winner will be notified by email using the email address provided in the Sweepstakes entry (“Prize Notification”) and each Potential Winner must respond by email within seven (7) calendar days of the date of the Prize Notification (the “Prize Deadline”), with Potential Winner’s full name and a mailing address (“Mailing Information”) where Sponsor can send his/her Prize (if warranted), and a Declaration or Affidavit of Eligibility and Liability/Publicity Release in a form acceptable to the Administrator (collectively, the “Sweepstakes Documents”). The mailing address must be a street address (no P.O. Boxes). If any Potential Winner does not respond to the Prize Notification by the Prize Deadline, such Potential Winner will be disqualified and an alternate Potential Winner (for each unclaimed Prize) will be selected from all remaining eligible entries received for the original drawing. Sponsors and Administrator are not responsible for the failure for any reason whatsoever of Potential Winners’ to receive their Prize Notification or for Sponsors or Administrator to receive Potential Winners’ response and/or Sweepstakes Documents. Return of any Prize Notification or Sweepstakes Documents as undeliverable, the inability of Sponsor or Administrator to contact a Potential Winner, the failure of a Potential Winner to contact Sponsor or Administrator in a timely manner, the inability of a Potential Winner to accept or receive the Prize for any reason, and/or the non-acceptance by a Potential Winner of any Prize for any reason will result in disqualification of such Potential Winner, and alternate Potential Winner(s) will be selected randomly from all remaining eligible entries received. Potential Winners who receive Prizes are known as the “Winners”.

  1. PRIZE CONDITIONS: Odds of winning depend on the number of eligible Entries received during the Sweepstakes Period. All prize values are stated in United States dollars. Selection and specifics of all prizes will be determined at the Sponsors’ and Administrator’s sole discretion. If a stated prize is unavailable, Sponsors and Administrator have the right to substitute one or more items of equal or greater value, in their sole and absolute discretion. Winners are not entitled to any surplus between the actual retail value of his/her prize and its stated ARV. No cash redemption or prize substitution or exchange allowed. All prizes are non-transferable. Winners will be solely responsible for complying with any and all applicable federal, state, provincial, local or other statutes, regulations, and other laws and for bearing any VAT, withholding taxes, personal income taxes, customs duties or other taxes, fees, insurance, surcharges or other costs relating to any prize.

  2. REPRESENTATIONS: By entering the Sweepstakes, each entrant represents and warrants that: (a) the entrant meets all eligibility requirements of the Sweepstakes; (b) in entering and participating in the Sweepstakes, the entrant has complied with and will comply in all respects with these Rules and all applicable statutes, regulations and other laws; and (c) the information provided in the entrant’s entry, including without limitation all contact information, is true, accurate and complete in all respects.

GRANT OF RIGHTS: By accepting a prize, each Winner consents to the use of his/her name and/or likeness (voice, biographical information, city and state of residence, statements, photograph, and recording) for advertising and promotional purposes (including, but not limited to, use on Sponsors’ web site and/or Facebook pages without additional compensation, except where prohibited by law).
  4. RELEASE: All decisions of Sponsors and Administrator are final and binding; and entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules, except where prohibited by law. 10.  USE OF PERSONAL INFORMATION: In order to participate in this Sweepstakes, participants will be required to supply certain information about themselves. Sponsors have specified which information is mandatory in order to participate in the Sweepstakes. By entering the Sweepstakes, each participant agrees that such information can be used (a) by Administrator in connection with administering the Sweepstakes and (b) by Sponsors as set forth in the Privacy Policies.

11.  CHANGES; TERMINATION: Sponsors reserve the right to make changes or additions to these Rules and/or extend the dates of this Sweepstakes for any reason at any time. Sponsors’ and/or Administrator’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. Sponsors reserve the right to suspend, modify or terminate the Sweepstakes at any time and for any reason their its sole discretion, including without limitation in the event of fraud, abuse, tampering, or technical, administrative, financial or other difficulties. In such cases, Administrator will post notice on the Web Site. Should the Sweepstakes terminate prior to selection of a winner, an alternate means of awarding the prizes will be announced on the Web Site.

12.  CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

13.  DISPUTES: Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in San Francisco, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys fees and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased.

14.  MISCELLANEOUS: If any part of these Rules is held by a court of competent jurisdiction to be invalid, illegal, or otherwise unenforceable, such part will be modified by such court to the minimum extent necessary to make it enforceable while preserving to the maximum extent possible the original intent of Sponsor, and the remaining parts of these Rules will remain in full force and effect.
